There is also something else at present far harder to put into words that don't sound silly and arrogant and even off with the fairies: I retire away from the 'cleveratti' often. As today.
20 years ago i would say to myself it seems there became a culture to out-clever one another. Maybe it began with the likes of recently departed De Bono. So much cleverness, and i know it serves only to confuse.
And in two respects this has in my opinion overwhelmed what are fairly simple cases of right and wrong. That won't chime yet and not here but The first is...
sort of Pilgerite i am always suspect of all law... no one emphasises enough law ...changes...it is called progress and civilisation. There were laws against women voting 100 odd years ago! I am not a complete anarchist because i know full well we need many laws to protect the environment because humans just cannot be trusted to not defile their own garden. But i did not have any inner simplified legalistic language. Perhaps few do in our present culture .
Anyway law....how dull knew nothing of it... then forced to do some to save my own bacon - this is not just about family law at all, but it was well known 10 or 15 years ago all family lawyers were fairly awful (as family lawyers would privately share with me) are pretty useless and dont care much ) in fact it really is the case that if you cannot get a job in other fields of law you end up in family.
Nothing to do with me... but eventually one has to in various walks of life bone upon something one is bored to death by. But i was so contemptuous of the whole flawed shooting match even though i would pontificate later on in statements and representations to judges in other case si did for others about 'case authorities' and 'precedent' ... I too would zap off fancy clever looking pages of precedents to blast back at the 'other side' i would never even give even the (as satted on grapevine) important ones ore than the slightest glance. Because you also discover as you get into the field of law it is just as much, maybe moreso, theatre...
And in theatre something that really does sway the audience is authenticity. And the most authentic performance is that based on truth, simplest right and worong. And ones STORY...
All those precdents and fancy legal stuff just distracts... tell your story gaze fixd...honest and straight...
and at the same time sum up the simpler rghts and wrongs.
And i discovered so few would even be able to lsiten to thos as of 5 or 10 years ago. It is how i pulled this out of the bag with my hands at first tied behind my back (in late 2003). Find the right and wrong...
not from some law text or precedent from simple straightforw ward literature or just fables we all know...and tell real stories - dont let the nasty antagonistic social worker steal the show, tell the judge how in fact that day in question the child in question after a little rumpus then went on to later on tell you s/he cared for aunty Flow and her drinking or something real....something that cannot be made up for cynical self serving vanity reasons something that is real from real life .. that shows all is generally good...
And if a bit of a poncy once-Guardian-reader like me you may add in as i would..."eh yeronerr... the SW reflects on two schools ina year being so so traumatically destabilising its grounds for removal....well i heard ex Chanvcellor LAwson on Desert Island Discs last month saying 'well i went to 11 diferent schools...and it clearly didnt do ME much harm.."
Justice is really just a game as someone once sung...
and you have to show the coicemakers with Solomon's harem in their backroom theyre probably keen to get back to after yet another dull loser like yourself that actually you haven't lost because you know all was well and what is right and wrong...and that is in no legal precedent.. in a way you have to create the game...to beat them at.
But here is another equally vague sounding thing but in fact is maybe even more an important technique that i have found also is sometimes necessary in mosst ordinary personal domestic world...
BUt in a way is linked. The faxes or nowadays emails start to zap in..maybe its court tomorrow and you are underprepared. Maybe a very hostile foe may even be wrongfooting by some tricky attempt at some last minute statement or wrongly concoted delaying tactic adjournment...
maybe a sort of lover or close person is scupperingdigitally something ongoing...or adjusting some plan for effect or strategy (that sounds wrong but i know what i mean)...
Don't.... open or read anything... (and i can quadruple tast and pivot on a pinhead) ... you ..if you are to continue in this engagement with maybe important person or even the whole damn jjustice system unless you are and have always been psycho....know what SHOULD happen...what is right and wrong... the simpler basic foundational essence of the thing... NO new information, no latest text in maybe not thought through will CHANGE WHAT YOU MUST DO in the bugger picture in the coming hourse....do not open that text do not bother opening those emails ... you focus on what you need to say and do to get said because only you are saying anything vaguely sane... keep the medum term best outcome in sight... all the flak that at times starts to incoming...
its that which will TAKE from where you got to so far..
There is always a way to white lie later why you didnt see x or y... x or y is a dsitraction... if you are to be a friend to that incoming text stick to waht you were before...and the same applies to law if you believed in your cause ...you must or you would not have continued... ignore their clever flack and often ignore their processes... just keep on simplest steady as she goes...
i simply cannot find anyone any more who can do that....and thats the only way i did what was an almost impossible case on never any spare cash even for enough to happily eat.... and this seemingly reckless technique ever failed me... and i have never even read one chapter of one law book...
It is a game and you must own the game your own way.. ... and its not that hard in fact I'm fairly thick.
this bit really does need improving especially as in ways it is the key and i used to be a most controlly person about perfect comms, and sequences of paperwork...nope... you have to rise out of that to what is below it the simplest right and wrong.
